Article 36

The EFSA aims to deliver the best science at the right time and in the most appropriate way by effectively sharing the large scientific excellence available in Europe.

For this purpose, and in accordance with Article 36 of Regulation (EC) No 178/2002, the EFSA's Management Board has agreed on a list of competent organisations which may assist the EFSA with its mission.

Competent organizations on this list are approved to undertake work on behalf of the EFSA in fields such as:

  • data collection;
  • other preparatory work for scientific advice;
  • other scientific and technical assistance tasks, in particular relating to emerging issues and crisis situations.

This networking will promote a scientific cooperation framework for sharing information and knowledge, identifying common tasks and optimizing resource-efficiency and expertise. 

Article 36 organisations pursue public interest objectives and their organisational arrangements must include specific procedures and rules ensuring that any tasks entrusted to them by the EFSA will be performed in an independent fashion and with integrity.  These organisations also need to have a high level of scientific or technical expertise in one or several fields within the EFSA's mission.  Finally, they must be able to operate within a network whose framework is based in science.

Member States shall forward the names and references of the approved organisations to the EFSA, evidence that they comply with the criteria and details of their specific fields of competence.

Since organisations evolve and scientific needs may change in response to scientific developments and to reflect the political environment, this is a dynamic list which is subject to additions and alterations. Consequently, it shall be updated regularly. When designated organisations no longer meet the above-mentioned criteria, Member States shall withdraw their designation and immediately inform the EFSA, accompanied by the relevant evidence.

Over the last years, the EFSA has put several tools in place to facilitate both the updating of the list (online questionnaire) and the networking between organisations as a part of the Art36-NET project.
